Terms of Service
and Usage Agreement.

These Terms of Service (the "Agreement") constitute a legally binding agreement between you and zekmac Technologies Pte. Ltd. ("zekmac" or "we") regarding your use of zekmac bare-metal Apple hardware hosting services (the "Service").

By registering an account, completing a payment, or using the Service in any way, you confirm that you have read, understood, and agree to be bound by all terms of this Agreement.If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to this Agreement.

zekmac provides Apple Silicon-based bare-metal Mac server hosting, including but not limited to exclusive rental access to Mac mini M4 series nodes, with SSH, VNC, dedicated public IPs, and a management console. Specific configurations are subject to your order and the console display.

Services are provided "AS IS" and "AS AVAILABLE" with no guarantee of continuity, stability, or error-free operation.zekmac reserves the right to modify, suspend, or terminate all or part of the Service at any time, with or without notice.We may change service content, pricing, or features due to technical upgrades, business adjustments, regulatory requirements, or other reasons. Continued use after changes constitutes acceptance.

You must provide true, accurate, and complete registration information and are solely responsible for maintaining account security. You may not transfer, sell, or share your account credentials with any third party. zekmac is not liable for losses caused by user negligence, shared accounts, or weak passwords.

Any action taken through your account is deemed to be your own action, and you bear all resulting liability.You must notify us immediately if you discover any account anomaly. Charges incurred through account compromise remain your responsibility until we complete the resolution. We reserve the right to refuse registration, freeze, or terminate any account without explanation.

• Billing:Service fees are prepaid for your selected billing cycle (daily/weekly/monthly/quarterly). Billing begins as soon as a node is provisioned, regardless of actual usage time
• Auto-renewal:Weekly, monthly, and quarterly plans auto-renew by default — charges are deducted automatically if not cancelled before renewal. Renewal reminders are a convenience feature and do not constitute a notification obligation
• Price adjustments:zekmac reserves the right to adjust service pricing at any time; changes take effect at the next billing cycle
• Overdue & suspension:In the event of overdue payment, we may immediately suspend the Service; all outstanding balances and any applicable late fees must be paid before service is restored
• Refund policy:Except as explicitly required by applicable law,all payments are non-refundable, regardless of whether the service was used. Due to the exclusive nature of hardware resources, refunds for personal reasons are not accepted after a node is provisioned. Promotional benefits are defined solely by zekmac; we reserve the right to modify or revoke them at any time

You agree not to use the Service for any of the following (not exhaustive):

• Violations of laws, export controls, or sanctions
• Cryptocurrency mining, distributed compute reselling, or resource arbitrage
• Network attacks, DDoS, port scanning, or brute-force attacks
• Distributing malware, spam, phishing, or illegal content
• Infringing third-party intellectual property or legal rights
• Circumventing technical restrictions, abusing APIs, or interfering with platform operations
• Reselling service to others (unless separately authorized in writing)

zekmac reserves the right to determine violations at its sole discretion and may immediately terminate service, ban IPs, permanently close accounts, forfeit balances without refund,and reserves the right to pursue legal action, all without prior notice.

zekmac makes no SLA commitments. We are not liable for any compensation for service interruptions or performance degradation caused by maintenance, hardware failures, network congestion, DDoS, natural disasters, third-party outages, upstream carrier failures, or any other reason, and will not provide time credits or fee reductions.

We reserve the right to perform maintenance, upgrades, or resource reallocation without notice. Scheduled maintenance windows (if announced) do not constitute a notification obligation.

Users are solely responsible for data stored or processed on the service. Data may be immediately deleted upon service expiry or termination — we do not guarantee retention or export. Users must back up their data within the active period. zekmac is not liable for data loss due to failure to back up.

Upon account termination, nodes will be reclaimed and all data within the node will be permanently deleted —zekmac is not responsible for retaining or exporting your data.

All intellectual property rights to the zekmac platform, website, API, documentation, trademarks, and related technologies belong to zekmac or its licensors. Users are granted only a limited, non-exclusive, non-transferable right to use the service during the paid period in accordance with these Terms. Copying, modifying, reverse engineering, or creating derivative works is prohibited.

To the fullest extent permitted by applicable law, zekmac shall bearno liabilityfor any direct, indirect, incidental, special, punitive, or consequential damages arising from use or inability to use the Service, including but not limited to data loss, business interruption, or loss of profits.

Total liability for any single event shall not exceed the corresponding order amount, and in no case shall exceed USD 100.Users assume all risks of using the Service.

We reserve the right to modify, suspend, or terminate any or all of the Service at any time without prior notice, consent, or compensation. zekmac may suspend or terminate your account at any time for any reason, including but not limited to violation of this Agreement, overdue payment, suspected fraud, or legal compliance requirements.

If a user requests termination of service,fees already paid are non-refundable. Data may be deleted immediately upon termination.

This Agreement is governed by the laws ofSingapore. Any dispute arising from or in connection with this Agreement shall be submitted to theSingapore International Arbitration Centre (SIAC)for final resolution in accordance with its rules then in force. The seat of arbitration shall be Singapore and the language shall be English.

You expressly waive any right to participate in class actions, class arbitrations, or jury trials.

zekmac reserves the right to modify this Agreement at any timewithout prior notice or user consent. Revised versions will be published on this page. Continued use of the Service after a modification is published constitutes your acceptance of the revised Agreement. If you disagree, you should stop using the Service and close your account.fees already paid are non-refundable。

This Agreement, together with our Privacy Policy and any supplemental terms within the console, constitutes the entire agreement between you and zekmac regarding your use of the Service. If any provision of this Agreement is found invalid, the remaining provisions remain in full effect.
